After she shot #1, shots 2 and 3 came boom boom. The vehicle was speeding away at a high rate of speed, down a car-filled street and yards with pedestrians everywhere.

Ross had no way of knowing if she had been hit; he was being hit by the vehicle as he shot.

Don't misunderstand, I do not like shots 2-3, in such an area, but I do understand them. If they both hit the vehicle, and he had a clear, easy target silhouetted, if true, this would mitigate some of those concerns 

Much like him wandering in front of the van, he didn't have to be there, but his being there doesn't give her the right to hit him with her vehicle.
