Exactly my point.   They have to have cooperation from the other twin in order to walk, to pick up objects, to turn in a certain direction, etc etc.     It would be impossible for one twin to be able to murder someone without the cooperation from the other twin.    The 'innocent' twin could easily interrupt any murder attempt as well by simply moving their side of the body or falling to a knee on their side of the body, etc etc

The fact remains, you simply cannot punish one without punishing the other.

And something about your 8th Amendment springs to mind.

Forbidding punishments that are barbaric and all that jazz.

Not really. They each control one side, right. If they were standing there and one twin wasn't watching what the other was doing { and why would they ? They spend every second of their lives with them and the last thing you'd do is notice every movement } it would be easy for one to pick up a knife, take one step forward and stab someone too quickly for the other to react.

That's why I thought this was so interesting. There's a lot of "what ifs" about it and the legal case could carry on for years.

What I"m saying is that the 'innocent' one wouldn't be innocent.
It would be impossible for the one that struck the murder blow to be 
able to do it all on  his/her own.   The only way they could would be
cooperation by the other twin.   So they'd both be guilty.

If we were to go further down the rabbit hole.

What about people with multiple personalities?

If one of those personalities were to commit a serious crime.

And another inform the Police or confess to knowing it happened. 

Who gets prosecuted, the individual or the personality responsible?

What happens next, aside from most likely them being sectioned?

That's just it ... the murdering one couldn't 'take one step forward' without the cooperation from the other twin.   And the murdering one couldn't even get ahold of a gun or knife without the cooperation of the 'innocent' one either.

I say they'd both be guilty.

I understand your reasoning.

But if they had a half-decent defence lawyer and/or team.

Imagine trying to prosecute/prove the crime in a court.

I mean, Lady Justice would really have to remove the blindfold, and then some.  Wink2
