Deport Everyone, My Liege.
Recently, King Trump has decided "gangs" qualify under the Enemies Aliens Act of 1798 as "Enemy nations."
In this used logic the Tren de Aragua gang becomes synonymous with Venezuela (The nation and government) and ALL qualifying people from that nation, regardless of gang affiliation, can be removed.
This is why the judge halted, or tried to halt the planes, it's unconstitutional to declare a gang a country and use that to deport people under this act.
Unless we declare war on the country itself.
But he's gonna do it anyway, appeal, send it up, and if it becomes a constitutional EO to declare a gang as synonymous with a country and use this act to deport EVERYONE applicable from said country, I have a request.
Get everyone equally. If this is the logic employeed and we can remove all unnaturalized immigrants from an undeclared "enemy nation" via loophole, do it across the board and show this isn't selective abuse of law interpretation and power.
This means he is equating this gang AS A HOSTILE NATION OR GOVERNMENT. That's how the act was applied in WWII. And was historically applied. We declared war on the nation first. He can't declare a gang as a nation to use this act without a slippery slope right into my Reductio Ad Absurdum argument.

Tren de Aragua = Venezuela
Then...
Medellin Cartel = Colombia
Sina Loa = Mexico
Jalisco = Guatemala
MS-13 = El Salvador
The Valle Cartel = Hondurus
Hezbollah = Lebanon
Pick Your Martyrs Brigade In = Syria
Hamas = Palestine
Triads = China
That's a lot of assumed enemies with this logic. And in places like Lebanon, the declared terror organization has a lot of parliament seats, so it's much easier.

So interesting that you are aware of exactly how international criminal organizations exist, how they themselves operate, largely as any nations militia or even mercenary units do. That they have a 'center' and they all seem existentially linked with nation states whose representatives look at the floor while whistling, whenever the inquiry is made.
For years I have wondered why MS-13 for example has suddenly, magically, become in the media "a gang" when it's claim to fame was always terrorist political assassinations and shock-violence?
But here in the U.S. they are called a "gang"... like some errant teens, overamped biker clubs, or Mafiosi wannabes.
Tren de Agua folks consider themselves soldiers.
That should be a clue as to what they reality behind the many crafted words is.

Who to deport?.... I think deportation is only half a solution - IF - we are to believe there is some specific "enemy" we are 'confronting.'

When the Tijuana Cartel smuggles meth and fentanyl tabs inside watermelons through the truck crossing are they acting as the Nation of Mexico? Does their incursion of drugs through our border amount to a Mexican-sanctioned assault on our sovereignty?
Are the cartels and many associated gangs "enemy aliens?"
The truck driver mule? Does he go to the prison in El Salvador too?

We need a new bill, not this act, for the removal of immigrant gang-members (like MS-13) from other countries. Because this one requires too much assumption and false equivalency to constitutionally pulled off. They are not acting on behalf of any nation state. It is woefully insufficient to apply THIS ACT to deporting gang members.
Congress needs to draft a bill to allow the deportation of hostile foreign nationals for similar "enemy alien" reasons without needing a declaration of war or a foreign government represented.

Surely, if China invaded Taiwan, it's none of the US' business and your tax dollars shouldn't be spent defending it? Etc?

What I am trying to point at is that our traditionally-accepted names and terms for entities in this conflict are outdated.
If we are to assume that the approach this is "defensive" we also have to assume that we are not just suffering from the eventualities of the diaspora of 'borders,' but we are being 'attacked' by some interest antagonistic to our idea of order.
This is hybrid-war people. History will say that at the beginning of this war, most of the population did not see that it had started at all... probably because the boundaries and fields of engagement have become non-constrained... no one is outside the range of attack... militaries and overt war are like a thing of the "old fashioned" past... exclusive for the theatrics of destruction as public threat.
It's not about nations (if it ever was,) it's about the pilots of our collective ships... and what human baggage exists between them.
For me, it's about their gaming of the system... and what they sell... to whom, what price we all eventually pay.

The Trump Administration needs to be able to deport identified non-citizens who are not supposed to be in this country. Judicial activism, partisanship, and media amplification aside...
Make the case...
Is the objection truly constitutional, or is this a 'narrative' meant to serve the objectors' desire to promote the appearance of resisting the "everything evil" new regime? That world of theirs has become a playground of appearances, which I find many people not questioning generally.
As the public (now even across the globe) rail against, or defend anything reported as an "action" by Trump, we often fail to consider that the "appearances" are being reported as fact. While usually all facts, are never reported without interpretation. (This is not to deny that they hold the best hand in flatly stating what is and isn't disinformation - that was always THEIR domain.)
I suppose once adjudicated... this will be resolved... or what's that other word?: "Settled."
