Trans Patient Sues Hospital for Comments Made While Anesthetized

Here's a fun one.  

A man, living as a woman, has stage 4 metastatic rectal cancer and had a lung tumor removed at a hospital.   He somehow secretly recorded what the surgeons were talking about during his surgery.   He is claiming discrimination because while he was anesthetized the doctors referred to him as 'him/he' and that they said they didn't understand trans and that he still had 'man parts'.   The hospital defends the doctors and staff saying it's a private conversation that they are allowed to have and recording them violates their privacy, and that they weren't mocking anyone during the recording.  The trans person also claims that the hospital changed his records to say 'he' instead of she, which the hospital denies.

It should be noted that most of the audio is not able to be understood because of the poor quality of the recording.

 Capasso became an MSK patient after being diagnosed with stage 4 metastatic rectal cancer in 2020 and claims she was mistreated throughout her multi-year treatment at the facility.  She caught doctors allegedly mocking her after she secretly made an audio recording of a March 2022 surgery to remove a malignant tumor from her lung, the lawsuit said.


Operating room staff commented on her having 'man parts,' said being trans was 'not right' and 'doesn't make sense,' and referred to both Capasso and her transgender partner as 'men,' the complaint alleged.  The lawsuit further claims that an operating room nurse called a hospital administrator during the procedure to demand that Capasso's sex designation in her patient records be changed from 'female' to 'male.' 


The hospital staff were having a normal conversation and weren't mocking anyone.   If they had made snide comments about penis size then that would be mocking, but saying you don't understand the whole trans thing and that he still had man parts is not mocking.   Also, it's natural to use the pronoun 'he' when dealing with a biological male because that what he is.

Then there is this ...

The staff used the trans pronouns in documents and to the mans face.   While in private conversation they called him what he is ... a 'he'.   That's private conversation.

It's almost like forcing one to use preferred pronouns is like forcing another to accept and pray to god.

The same "Go ahead and try to make me!" switch is flipped, and the story is never going to end until the world confronts that part of it.

It's, "go ahead and try to make me be a man" fighting "go ahead and try to call yourself a woman" and it is designed to be repulsive to one-another.  

It's like a feedback loop increasing in amplitude.

Well okay whatever but there are very good reasons for doctors with a patient under anaesthetic to not introduce the possibility of confusion by referring to them as the incorrect (or "preferred", or whatever) sex. Same with data on medical charts. Thinking your name is dead is one thing, being actually dead is another.

Like humanity has a collective martyr complex or something...

The personal belief that leads anyone to defiance is religious in form. Deeply held convictions you devote yourself to, even if not idol based or spiritual, carry the same weight when they guide your actions.

You can't tell most LGBT people to refuse another's preferred identity, any more than you can tell most fundamentalists to embrace it. 

It's religion's second definition applied to the first where applicable, or not, but leading to the similar results across the board.

And you can certainly ascribe supreme importance towards ideas like diversity and inclusion, promote it through your actions, and have it be every bit a personal gospel guiding you.  I do that all the time.

To tie it back to the thread: 

It was personal belief of supreme importance that led this woman to get sick of her treatment history at this hospital, to the point she secretly recorded their ongoing behavior during surgery.
