I'm not an immigration lawyer, but I believe that is correct. That is why he was detained; he never should have been released into the United States by the previous administration. I am unsure if there is any specific finding of illegality on the Biden administration for their actions in violation of the law.

There haven't been any criminal records released by the current administration. Which doesn't mean there aren't, just that they're not claiming any. Which I would think they probably would do if they existed.
