Just a bit of thinking outside the box. Comey on page 163 states that there were 36 email chains that were Top Secret and could cause serious damage to the U.S. national security and there were 8 additional ones that would cause exceptionally grave damage. Line 17.

So Comey reopened the Clinton email investigation October 28, 11 days before the election. It felt very odd to me that he would do this on Billy's birthday., but then again we are talking about Billy.

This was bout Clinton and the mishandled classified information.

I'm parsing through his actions. 

Loretta Lynch assigned this and most oddly  to very low level FBI agents. Comey claims he knew nothing about it until he was briefed by the deputy director. Comey always names names but doesn't here.

Clinton initially was using a Blackberry and then switched over to Clintonmail.com domain. Weiner's laptop contained the emails from the Blackberry. Comey can't fathom how those emails could have possibly landed on there. Eureka  I don't know, Huma worked for Clinton.

He admits that they were clearly classified information but for some strange reason he focused on the issue of what she could have been possibly thinking.
Page 163 Comey reviews the case of classified information leaked by CIA Director David Petraeus in 2011.

"Petraeus had given multiple notebooks containing troves of highly sensitive, top- secret information to an author he was having an affair. In contrast to those Hillary Clinton corresponded with, the author did not have appropriate clearance or a legitimate need to know the information, which included notes of discussions with President Obama about very sensitive programs."

The result was he admitted guilt in April 2015 and he was fined $40 K and probation for 2 years. Wow

Eric Holder made that decision.

Sooo they started the investigation but Comey was already of the opinion that prosecutors at the DOJ would not prosecute.

Comey believed the only way to make a case was to find a smoking-gun email where someone in government would tell her she wasn't suppose to do this communication on her personal email account.


Comey appears very tortured over what to do. 
"You know your screwed, right?
"I smiled tightly, Yup. Nobody gets out alive."

Loretta Lynch finally agreed that they needed to confirm to the public that indeed an investigation had been launched, LL told Comey to call it "a matter". When he questioned it she told him "To just do it?" Page 169 & 170.

Then we have the matter that there is material that is classified that would "cast serious doubt on the attorney general's independence in connection with the Clinton investigation."

"But it bothered me that there was classified information that would someday become public- likely decades from now- and be used to attack the integrity of the investigation and, more important, call into question the independence of the FBI.

He went to his boss Sally Yates and suggested that they really needed to be transparent with the public and asked her if she could put people to work on researching what was possible under the law. "I never heard back."

Page 178-
In mid-June the Russian government began dumping emails stolen from institutions associated with the Democratic Party. It began with DCLeaks and Guciffer 2.0.

Comey was concerned -"THIS MADE VERY REAL THE PROSPECT THAT THE CLASSIFIED MATERIAL RELATED TO LORETTA LYNCH MIGHT DROP AT ANY MOMENT, NOT DECADES FROM NOW. AS NOTED EARLIER, THE RELEAASE OF THAT MATERIAL, THE TRUTH OF WHICH WE HAD NOT VERIFIED, WOULD ALLOW PARTISIANS TO ARGUE, POWERFULLY , THAT THE CLINTON CAMPAIGN, THROUGH LORETTA LYNCH, HAD BEEN CONTROLLING THE FBI'S INVESTIGATION." Wow

I have no idea why Comey believed that it would be "brutally unfair" to call for the appointment of a special prosecutor. "Calling for a prosecutor now would wrongly imply there was something to the case, which would then drag on for many months, if not longer."

To protect the integrity of the FBI. Comey made the decision to distance them from Loretta Lynch- "have the FBI separately offer its views to the American people as soon as possible, by making public my recommendation and the thinking behind it.

There was no way he was going to win, the Dems would believe he wanted the spotlight for himself and the Republicans would believe that there was massive corruption.
Many questioned why the FBI took so long to interview Clinton. 

"That is exactly the reason.  Experienced investigators always avoid conducting interviews with subjects  who know more about the facts than they do. That knowledge imbalance favors the subject, not the investigators."

I've already covered the sham interview, where she wasn't placed under oath and not tapped, and that Comey did not attend.

This is weird- he declares that her" lack of technological sophistication is evident in her memoir, "What Happened", in which she seems to intimate that her private server in Chappaqua was protected from hacking because it was contained in a home guarded by Secret Service." Lol

"She also said in her interview that she believed she and her staff had successfully "talked around" sensitive topics, a method of operating made necessary by the State Department's poor communication infrastructure, which didn't provide secure and reliable email and phone for her and senior staff." WUT?

In the interview Clinton claimed that she delegated the review and deletion of her emails to others."

Whether they believed her or not Comey claims there was no proof of what she was thinking. Highly classified material, who cares, it was about her thoughts.

There is some very unusual behavior. Comey decided to make the announcement July 5 without any prior consultation with his boss Sally Yates or Loretta Lynch. This being a very high profile case. That morning he called Yates and told her what he was doing and Yates said nothing- she is his boss.
He called Lynch and she asked what he would be recommending and he refused to tell her. Question

But then he authorized an email to be sent to the FBI staff that his recommendations would be that no charges would be made.

Some real strangeness, all of the work done by the FBI agents was done with no publicly released information.
But in "appropriate" cases where the public interest requires it, the DOJ has long revealed details about the conduct of uncharged people. The Department had done so in the spring of 2015 after the FBI's investigation of the killing of Michael Brown in Ferguson, Missouri- including releasing an 80 page report detailing the entire investigation.
So he closed the case the first time July 5th, leaving 26 days in July.

October 27, 12 days before the election- McCabe sent me an email that the Midyear team needed to meet me."  "Members of the team explained that it appeared Weiner's laptop contained hundreds of thousands of emails from Hillary Clinton's personal email domain."

Originally there were 60,000 emails, with 30,000 deleted that were provided by Hillary's lawyers.

"But there was something that caught their attention." The Midyear team had not been able to find any of the first months emails when she was using her Blackberry.  

They were hoping that it would reveal some smoking-gun that she had been instructed to not use her personal email system or in which she acknowledged doing something improper with classified materials."

The team got a warrant to search the rest of Weiner's laptop. Imagine they had to try and read all these emails, no one else from the FBI could assist because they would not have any context.  "The team said there was no chance that they could review all these emails before the November 8 election. Page 193.

Meanwhile Obama and friends wanted to issue a statement that there was Russian interference in the presidential election, which Comey would not sign off on.

"If this was a brand new investigation, doing nothing would have been an option."

Now Comey does something unusual. He previously had locked out Loretta Lynch and Sally Yates but now faced with this he needed to tell them he was reopening the case.

"But, through their staffs, Lynch and Yates communicated that they thought this was a bad idea, that they would advise against it, but that it was my call and they didn't see a need to speak with me about it." They didn't order me not to do it, an order I would have followed."

October 28 he sent a letter to Congress and an email to his staff saying that he was reopening the Clinton email investigation.


Loretta Lynch took Comey aside and asked him "Would they feel better if it leaked November 4th?"
"Exactly, Loretta."
Not really possible since the search warrant had been issued. Then she said something odd "Try to look beat up" in that she had disciplined him he assumed.

The FBI Operational Technology Division figured out a way to reduce the number of email duplicates so the team was able to read them all before the election. More emails contained classified information.

He was going to have to write to Congress to say once again he was closing the case, on Sunday November 6th, 2 days before the election.

Page 207 "A different FBI director might have called for the appointment of a special prosecutor in late June, after Bill Clinton's visit to the attorney general's plane. I still think it would have been unfair to Hillary Clinton, but I can imagine another director doing it that way rather than trying to protect the institutions the way I did."

"Or another person might have decided to wait to see what investigators could see once they got a search warrant for the Clinton emails on Anthony Weiner's computer."

The best question-" I've asked myself a hundred times whether I should have pressed for faster action after hearing about Weiner's laptop around the beginning of October." His assumption was that if it was important someone would bring it to his attention.
