He's claiming The 28Th Amendment was ratified!

The DOJ actually said it wasn't in a report in 2022.

Apparently the States didn't "Ratify" in time allowed by law.

Joe Biden Falsely Declares States Ratified Equal Rights Amendment (ERA) to Constitution

WASHINGTON, DC – President Joe Biden on Friday made the bizarre proclamation that the proposed Equal Rights Amendment (ERA) to the U.S. Constitution was ratified by 38 states to become part of the U.S. Constitution, an announcement that is legally dead wrong and a disgraceful disservice to the country and the rule of law.
 
The Constitution requires that any amendment must be proposed by both two-thirds of the House (290) and two-thirds of the Senate (67). After that, a majority (over 50 percent) in the legislatures of three-fourths of the states (38) must vote to ratify the proposed amendment to make it part of the Constitution. All this has happened only 27 times in American history, starting with the Bill of Rights in 1791.
 
Congress proposed the ERA in 1972 as a top priority of the Far Left. It says, “Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex.”

On January 27, 2020, the Commonwealth of Virginia became the 38th state to ratify the Equal Rights Amendment. The American Bar Association (ABA) has recognized that the Equal Rights Amendment has cleared all necessary hurdles to be formally added to the Constitution as the 28th Amendment. I agree with the ABA and with leading legal constitutional scholars that the Equal Rights Amendment has become part of our Constitution.
 
It is long past time to recognize the will of the American people. In keeping with my oath and duty to Constitution and country, I affirm what I believe and what three-fourths of the states have ratified: the 28th Amendment is the law of the land, guaranteeing all Americans equal rights and protections under the law regardless of their sex.

Biden Proved Wrong on ERA Amendment by National Archives, Community Notes

The eligibility for ratification long expired, according to the National Archives. Several states have also rescinded their ratification. Nevada voted to ratify the ERA in 2017, becoming the first state to do so since 1977. Thirty-eight states were required to ratify the amendment in order for it to pass, though that didn't happen until Virginia did so in January 2020, according to the Brennan Center
 
Further, in January 2022--during Biden's term--the Assistant Attorney General Office of Legal Counsel at the Department of Justice (DOJ) released a memo for the Counsel to the President on the legal status for ratifying the ERA.
 
"Whether the ERA is part of the Constitution will be resolved not by an OLC opinion but by the courts and Congress. Indeed, the status of the ERA, including important questions about Congress’s role in the amendment process, is the subject of ongoing litigation, with additional lawsuits almost certain to be filed shortly," the memo from Christopher H. Schroeder read at one point.
