Remember when all of the US communication service carriers were discovered to have been surveilling their customers illegally over years? Remember how they were granted "retroactive immunity" by the government.
I may be wrong, but...
To use the word "preemptive" would mean forgiveness for a crime BEFORE it is committed, not a crime that has already taken place. If you wanted to forgive 'preemptively' the crime would have to be identified and charged...
"Preemptive pardon" seems to be a flimflammery of legal misdirection... essentially 'forgiving' a crime "yet uncommitted"...
If the crime was committed in the past the proper word for the presidential pardon would be "retroactive," NOT "preemptive."
What the authors of this idea are trying to do is to also avoid any NEW charges over the crime (and presumably accomplices.)
Had I any voice in the matter I would insist that any such pardon must bear the burden of full specificity with clear admission of knowledge... you can only pardon what you know... not "anything" the future will reveal.
This won't be "Biden's" work... it will be the work of the committee that has been running things... and of course, their owners.
