Fusarium is a nasty pathogen.   Once it is in the plant, not much you can do.

Is it breaking a law trying to smuggle it? 

I’ll bet some Kash it’s breaking a law, at the very least. And this is strike two?? Why so eager to smuggle it?? Lock them up.

IIRC, the smuggled strain is not native to the USA and targets food crops like wheat and rice.

Yes, it's breaking the law to bring it into the country without declaring it on your customs form.  If you do declare it on the customs form, then you have to have a permit or license for it.  It's basically the same as if you bought some avocados in Mexico and put them in your luggage and didn't declare them when you came back to the US.  If they were infected, they could threaten the US avocado crop. These laws are in place to control the importation of biological materials that could harm US crops and animals.  

This guy was a biological researcher and was taking a short cut.  He could probably have purchased the very same organism from a lab supply house, but it would have taken more time and money.  It was a stupid move on his part, but not particularly destructive in the great scheme of things.

When due to weather if we had to divert to an alternate destination coming back to the states the longest time consuming thing that was done is remove all food items that were supplied overseas..Bugs, parasites, you name it are a big deal with customs ... 

Corporate guys going to Mexico (fishing trips or hunting  birds) could just pay a bribe amount to the local yokels and not even be inspected if going to Mexico... Turbo-prop in the 80s was $50 and a jet (depending on what kind was around $75 for a Saber-liner) Mexico has been corrupt by western standards since before any of us alive today were born.
